Man Sues Microsoft Over Xbox LIVE Subscription

A Georgian man is filing a suit against Microsoft allegedly claiming the company allowed his underaged son to sign up for an Xbox LIVE subscription with the man’s debit card.

Georgia resident Francisco Garcia claims that in October 2005 his son, Silvario, used his debit card to buy a $49.99, one-year subscription to Xbox Live.

A year later, Microsoft automatically renewed the Xbox LIVE subscription causing the man’s bank account to go into overdraft, hitting him with a $35 fee. Garcia claims, Microsoft “fraudulently induced a contractual relationship for Xbox Live services.”

Garcia is filing for unknown damages and would like to broaden to the case to other consumers in Georgia. Microsoft is trying to resolve the case by having the court throw it out due to paperwork proving Garcia’s son falsely stated his age.
